STATEMENT BY SECRETARY OF STATE HUSTED ON LEGAL ARGUMENT AGAINST ROTHENBERG V. HUSTED LAWSUIT
COLUMBUS – The following may be attributed in whole, or in part, to Secretary of State Jon Husted regarding today’s filing of a legal argument against the lawsuit, Rothenberg v. Husted, questioning the validity of petitions circulated by proponents of the recently certified health care amendment. A copy of the argument filed with the court today is available online at: www.ohiosecretaryofstate.gov/sos/upload/news/20110809.pdf
“Ohio law is clear as it relates to the requirements for paid circulators of petitions for statewide issues. To argue that part-petitions are somehow invalid because circulators provided too much information goes against the intent of law, which is designed to ensure full disclosure and transparency.
“Circulators of the Health Care Freedom Act followed the law, secured enough signatures and should have the opportunity to put this issue before the voters this November.”
